Regulatory Bodies: ASA, YouTube

There is nothing in my promotional video that would conflict with any of the UK Regulatory bodies’ codes (UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (CAP Code). I thought as the band and I wanted the video online on social media sites such as YouTube then I would also take a look in the privacy laws on their website to make sure nothing conflicts with them either.

Privacy
I felt this was quite an important issue to look into on the ASA website. For My promotional video it is heavily relied on their background and how they go to where they are now.

In a couple of scenes they talk about who used to be in the band and for privacy reasons the band only mention them by their first names so there are no ways which these people can be picked out and they are only referred to when talking about the band history.

We also recommend the band not mention any of the names of the songs which the band wrote their songs about In case there are any rules broken about the privacy act.

I took a look onto the YouTube Website for similar information about regulation and to see what I am personally allowed to upload to YouTube. So I thought I would look into the privacy act they have online to see if it differs from the one I have previously mentioned.

For content to be considered for removal, an individual must be uniquely identifiable. When assessing if an individual is uniquely identifiable, we consider the following factors:
  • Your image or voice 
  • Full name 
  • Financial information 
  • Contact information 
  • Other personally identifiable information 
Violent or graphic content
If the violence would have been shown in my video, I would have to make sure to post as much information as possible in the title and metadata to help viewers understand what they are seeing. Providing documentary or educational context can help the viewer, and our reviewers, understand why they may be seeing the disturbing content.
Harm and Offence

Hate speech refers to content that promotes violence or hatred against individuals or groups based on certain attributes, such as:
  • Race or ethnic origin 
  • Religion 
  • Disability 
  • Gender 
  • Age 
  • Veteran status 
  • Sexual orientation/gender identity 
For this I wanted to make sure that there was nothing which would get my video taken down or flag so I took a look into both the ASA website and also YouTube to see what I must not include in my video.

The Points I made above are the things which the band would not be allowed to talk about in a harmful manor. None of this is present in my video.

Children 
Care should be taken when featuring or addressing children in marketing communications. 

There are no children used in my promotional video nor are they any scenes in which a child would look at the video and do something bad because of what they have seen.

If anything the video will have a more positive affect on children viewing the video as it might get them to start learning new things and beginning new hobbies which would not be a bad thing.
